摘要(Abstract)：

目的探索我国建立和完善药品市场信用制度的可行性。方法通过对我国药品市场信用制度缺失状况进行分析,从上位法、现有规定的操作性、信息记录和信用评价指标等方面阐述我国药品市场中信用法律制度建立所遇到的问题,借鉴国外药品市场信用制度的成功经验。结果必须尽快建立和完善药品市场经济信用法律制度。结论设立惩罚失信行为的法律规范,提高失信者失信成本;设立采集和使用信用信息的法律规范,提高社会信用信息对称程度;及时修订法律法规,解决企业信用体系的法律框架问题;建立和完善公示制度,设立信用评估的统一规范,增强信用评估结果可信度。
Objective To explore the feasibility of establishing and improving the credit system of China pharmaceutical market. Methods By analyzing the absence of credit system in China pharmaceutical market,the problem on establishing the credit law system was elaborated from the aspect of higher level of laws,the interoperability of existing provisions,information records,and credit evaluation indexes. The successful experience of foreign countries was used as reference. Results The credit system of China pharmaceutical market should be established as soon as possible. Conclusion Constitute the legal norms of punishing the dishonest acts to increase the dishonesty cost. Establish the regulations on collecting and using information to enhance the level of social credit information symmetry. Amend laws and regulations timely and resolve the legal framework questions of corporation credit system. Establish and improve the public system,develop the standard credit evaluation index to enhance the credibility of the assessment results.
